THRIVE STUDIO – TERMS & CONDITIONS

These Terms & Conditions apply to all classes, memberships, services, and use of facilities provided by Thrive Studio (“the Studio”, “we”, “us”, or “our”). By booking or attending classes at Thrive Studio, you agree to be bound by these Terms & Conditions.
1. Modifications of Terms & Conditions
Thrive Studio reserves the right to amend these Terms & Conditions at any time, including but not limited to pricing, policies, schedules, cancellation rules, subscriptions and membership terms.
Any changes will be communicated at least thirty (30) days in advance via email and/or the Thrive Studio website. Continued use of the Studio’s services after the effective date of such changes constitutes acceptance of the revised Terms & Conditions.
2. Pricing, Fees & Payment Terms
Prices for classes, class packs, memberships, subscriptions, and private sessions are set for a defined period only and may be reviewed periodically.
All classes, class packs, memberships, subscriptions, and private sessions must be paid in advance unless otherwise agreed in writing.
Where recurring memberships or subscriptions are billed monthly, payments are due on the agreed billing date. Any invoice issued by Thrive Studio is payable within ten (10) calendar days of the invoice date.
All prices are inclusive of VAT.
3. Late Payments & Recovery Costs
In accordance with Luxembourg and EU regulations, any amounts remaining unpaid more than thirty (30) days after the invoice date may incur statutory late-payment interest at a minimum rate of 8%, based on the applicable EU statutory interest rate.
Thrive Studio reserves the right to charge:
A fixed recovery cost of forty euros (€40), and
Reasonable additional compensation for recovery costs exceeding this amount, where applicable.
Where payment is unduly delayed, Thrive Studio reserves the right, upon written notice via email or inbox message, to suspend or restrict access to classes, bookings, memberships, or private sessions until payment is received. These rights will only be exercised where fair and reasonable.
If you believe that an invoiced amount is not fair or reasonable, you must notify us in writing within seven (7) calendar days of receipt of the invoice. If no such notice is received within this period, the invoice will be deemed accepted. Any undisputed portion of an invoice must be paid by the due date.
4. Refund Policy
All Drop-Ins, Class Packs, Subscriptions, Memberships, and Private Sessions are non-refundable and non-transferable.
Payments for classes, memberships, subscriptions, private sessions, and gift cards are non-refundable.
If a class booked via Drop-In or Class Pack is cancelled within the applicable cancellation window, the credit will automatically be returned to the client’s account for future use.
Unused classes expire automatically at the end of the validity period stated at purchase.
5. Cancellations, No-Shows & Penalty Fees
Thrive Studio operates a 12-hour cancellation policy for all group and reformer classes.
With 24 hours cancellation policy for private and duo sessions.
All cancellations must be processed directly by the client via Arketa. No exceptions apply.

All penalty fees are automatically charged to the payment method on file. Unpaid fees may result in booking restrictions, suspension of services, or termination of memberships or subscriptions.
Penalty fees are non-refundable.
6. Class Attendance & Punctuality
Clients must arrive at least five (5) minutes before class start time.
Late arrivals of more than five (5) minutes after class start may be refused entry for safety and class flow reasons. In such cases, the class will still be deducted or charged in full.
Studio doors may be locked once class begins.
7. Age Policy
Clients must be eighteen (18) years or older to attend classes at Thrive Studio.
Any exceptions must be approved by management in advance and in writing.
8. Dress Code
For all classes, clients must wear:
Comfortable, breathable athletic clothing suitable for movement
Appropriate clean indoor footwear, or bare feet / grip socks if preferred, depending on the class format
For safety and hygiene reasons, Thrive Studio reserves the right to refuse participation if attire or footwear is deemed unsuitable.
9. Studio Equipment & Mats
All equipment required for classes is provided by Thrive Studio.
Clients must clean and return all equipment after use using the disinfectant and towels provided.
Pilates mats are available free of charge. Clients may also bring their own mats if preferred.
10. Schedule & Bookings
Class schedules are released up to sixty (60) days in advance.
Waitlisted clients may be automatically added to a class up to two (2) hours before the class start time.
Clients must remove themselves from the waitlist if unable to attend. Standard late cancellation or no-show penalties apply.
Clients are responsible for monitoring Arketa notifications and their registered email address.
11. Client Code of Conduct
To ensure a safe, inclusive, and respectful environment, all clients agree to:
Treat teachers, staff, and fellow clients with respect
Follow all coaching instructions and safety guidelines
Use equipment responsibly and hygienically
Refrain from disruptive, aggressive, or inappropriate behaviour
Respect studio facilities and shared spaces
Thrive Studio reserves the right to refuse service, remove clients from class, or terminate memberships, subscriptions without refund if this Code of Conduct is violated or safety is compromised.
A Liability Waiver must be signed in order to attend classes. Access may be refused if this document has not been completed.
12. Health & Responsibility
Clients acknowledge that participation in Thrive Studio classes, events, workshops, and offerings involves physical activity and confirm that they are medically fit to participate.
Thrive Studio shall not be held liable for injuries resulting from failure to follow instructions, failure to disclose relevant medical conditions, or exercising beyond personal limits.
13. Hygiene & Studio Etiquette
Clients must bring their own towel and water bottle.
No food, glass containers, or pets are allowed (service animals excepted).
Mobile phones, smart watches, and personal electronic devices are not permitted during class. All devices must be on silent with notifications disabled.
14. Facilities & Personal Belongings
Thrive Studio is not liable for lost, stolen, or damaged personal items. All belongings are brought to the Studio at the client’s own risk.
15. Intellectual Property
All digital, written, and visual content is the property of CMPW Luxembourg Sàrl-s. Reproduction or distribution without prior written consent is strictly prohibited.
16. Limitation of Liability
Thrive Studio is not liable for injuries sustained during classes or on studio premises, except where such limitation is not permitted by law. Thrive Studio is not responsible for unavailable teachers, services, or equipment. A waiver has been issued to each client outlining the details and must be signed by each individual client prior to any participation in classes or services.
17. Personal Data & Privacy (GDPR)
Clients may request access, correction, or deletion of their personal data at any time by contacting Thrive Studio.
All requests will be handled in accordance with Luxembourg and EU data protection laws (GDPR) and within a reasonable timeframe.
18. Schedule, Location & Teacher Changes
Thrive Studio reserves the right to adjust class schedules, change class locations, or assign a different teacher without prior notice.
Classes may be cancelled for teacher training or internal studio development. Where possible, reasonable notice and alternative options will be provided.
